Stunning mutiny in Supreme Court Four Judges take on CJI

The Congress challenged Prime Minister Narendra Modi today after his Principal Secretary, Nripendra Misra, went to the house of Chief Justice Dipak Misra, who is facing criticism from four of the most senior judges of the Supreme Court.

He was appointed as Chief Justice of Punjab & Haryana High Court on 12th February 2011 and was elevated as Judge of the Supreme Court on 23rd April 2012.

On Friday, the top court asked the Maharashtra government to submit the postmortem report of the CBI judge, asserting that the "matter was very serious". Amongst those present were Secretary of HCBA Shashank Shekhar, Joint Secretary Amit Jain, Treasurer Anita Kaithwas, former Secretary Manish Tiwari.

The four justices at Friday's news conference - Chelameswar plus Ranjan Gogoi, Madan Lokur and Kurian Joseph - are the most senior after Misra.

Law Minister Ravi Shankar Prasad declined to comment. He however, felt that their action may amount to contempt of court. Top judicial experts, ranging from practicing senior advocates to retired judges and attorney generals have expressed shock over the unfolding of events. He had for some time been opposing the Collegium system and had complained that judicial appointments were many a time being made arbitrarily and to dole out favours to some people.

"It was unprecedented. Points raised by the Hon judges need to be looked into carefully, even Justice Loya's death needs to be investigated properly", Congress president Rahul Gandhi said while addressing the media in the party headquarter.

Efforts to alert the chief justice that certain things were not in order and that remedial measures were needed had failed, prompting the news conference, Chelameswar said. "I think we, the people of India, have a right to know what is going on within the judiciary & I welcome this".
