"States like South Dakota will now be allowed to require sellers that are selling substantial amounts of product into the state to collect and remit sales tax", he said.

MA law was similar to laws in several other states. Heitkamp suggested that states follow South Dakota's lead and enact laws tailored not to target small businesses.

While this ruling is beneficial to state governments, it stands to have a negative impact on retailers and consumers alike.

The decision also effectively acknowledged the profound shifts in the American retail landscape.

It's clear that the court's decision will mean extra cash for states.

Shares in online retailers like Amazon.com (amzn), Wayfair (w), Etsy, (etsy) Overstock.com (ostk) and eBay (ebay) all fell in the wake of the decision. The Retailers Association of MA called the ruling a big win for businesses.

Smaller online companies are anxious about calculating taxes for literally thousands of jurisdictions. The law makes an exception for companies with less than $100,000 in annual sales or 200 transactions in the state, seeking to help smaller retailers compete with big e-commerce incumbents.

"E-commerce has shown us over the last 10 years, most of those issues are, by and large, solved".

Sen. Eric Lesser, D-Longmeadow, Senate chairman of the Committee on Economic Development and Emerging Technologies, said the decision was the correct one. In 2014, Amazon, the largest online retailer, began collecting the tax in Florida after it opened a series of "fulfillment centers" in the state.
