NY regulators revoke Charter merger, tell them to leave

Charter Cable's Spectrum may be forced to stop doing business in NY for failing to live up to a service agreement and "misleading the public", a state utility regulator said Friday. As such, the commission concludes that it can no longer allow the company to operate in NY in good faith. So if Charter does not fulfill its requirements, the state won't be able to accurately say every New Yorker has access to high-speed internet service. But, the state Public Service Commission today (Friday) revoked its approval of the 2016 merger agreement saying that Charter made clear that it has no intention of providing the public benefits upon which the PSC's earlier approval was conditioned. We'll see how Charter responds and what actually comes of this, but with more than 2 million subscribers to Charter in NY, it's going to have a major impact on the television and internet landscape there.

"Charter's repeated failures to serve New Yorkers and honor its commitments are well documented and are only getting worse ..."

ALBANY, N.Y. NY regulators revoked their approval of Charter Communications Inc.'s merger with Time Warner Cable Inc. today and ordered the company to find another cable provider for its more than 2 million customers in the state.

They also can be something of a professional courtesy , allowing former national security officials to talk to their successors. Ryan said that the issue of revocation is within the purview of the executive branch, and not something that involves Congress.

The PSC accused Charter of repeatedly failing to meet deadlines, not filling its obligations to serve rural communities and "purposeful obfuscation of its performance".

The commission said it will begin a special proceeding or action in the New York State Supreme Court to seek penalties for Charter's violations.

The ruling shouldn't affect cable service to the company's NY customers. But the fact is that Spectrum has extended the reach of our advanced broadband network to more than 86,000 NY homes and businesses since our merger agreement with the (commission).

The commission is giving Charter 60 days to come up with an exit plan from NY and has ordered the firm to pay $3 million in penalties. It claimed the commission's charges were "politically motivated" and tied to the upcoming election season.

Charter spokesman Andrew Russell said later by email that the company would not comment on the substance of the commission's revocation action. They have 60 days to file a plan to ensure a new transition to another provider.

Further, PSC charged in its order Friday that some of the work Charter has done is unsafe, has caused damage to surrounding equipment, or does not comply with electrical codes.
